Is it illegal to lie to a process server about your identity?

Background info: I am suing for full custody of my daughter. The ex when asked his identity claimed he was only a workman at the house. When the server returned again, at this time he had his description and knew it was him, he (the server) confronted him. The ex lied again, when presented with the papers he chased the server off of his property screaming and throwing rocks at the server. So I am curious, is his lying and are his actions illegal? How does this stand to effect my petition for full custody?

  1. Your server should have just left the papers at your ex's workplace. You did give the process server your ex's work address, right? Would have been a lot easier. No, its not illegal to lie to a process server.
  2. Lying to process server = legal. Throwing rocks at process server = illegal. Asking the court to waive the requirement of service as a result of the other party's attempts to evade service = much easier when other party has lied to and thrown rocks at process server.
